Jimmy Carlton Winfrey filed the notice of appeal, first reported by Bossip, with lawyer Steve Sadow in a Georgia court on Dec. 18.
“The transcript of the guilty plea strongly suggests that my client was pressured, coerced into entering the plea by the comments of the trial judge indicating he would be punished or penalized severely if he did not take the plea,” Sadow tells Billboard.
Rappers Birdman and Young Thug were also named in the indictment, filed in June, implying their involvement though they were not charged with any crime. Sadow also denied that being a factor in Winfrey’s appeal.
On the night of the incident, Winfrey — a Young Thug associate — was accused of driving his Camaro alongside Wayne’s tour buses and opening fire. No injuries were reported by Atlanta and Cobb County police.

Last month, the judge handed Winfrey (also known as PeeWee or Roscoe) a 20-year sentence, including 10 years to serve in prison and 10 years of probation, after he pled guilty on six of 27 counts in Violation of the Street Gang Terrorism and Prevention Act.
