LONDON — European independent labels’ body Impala is to launch a court challenge to the Sony BMG merger, sources say. ELW has learned that Impala plans to announce its decision on Nov. 3.
Brussels-based Impala will challenge the merger before a European court on the grounds that the European Commission’s July 19 decision to clear the deal without conditions “was illegal,” according to a source close to the case.
Impala has been a vocal opponent to the merger since it was first announced. The trade group has been consulting with lawyers for months as to whether it should mount a formal challenge.
Representatives of Impala were traveling and not available for comment.
