A U.S. District Court judge on Friday denied a New York marketing company’s request for a preliminary injunction in a lawsuit against Universal Music Group that would have blocked the release of Bon Jovi’s album “Bounce” (Island Def Jam), Billboard Bulletin reports. The album, which has already shipped to retail, will be released tomorrow (Oct. 8) as scheduled. The suit is still pending in U.S. District Court for the Southern District of New York.
As previously reported, DownloadCard Inc., a specialist in personal identification number (PIN) management systems, is challenging UMG’s inclusion of a claimed proprietary technology in the album’s packaging that allows consumers to obtain bonuses online. The company alleges theft of trade secrets and seeks damages of at least $750,000.
DownloadCard — which claims its has collected $235,000 in fees from UMG in the last year for PIN promotions for Rusted Root, Musiq, Shelby Lynne, and others — says it owns the technology and generated the idea for the Bon Jovi promotion.
Island Def Jam is using a PIN system to offer buyers of “Bounce” early access to tickets for the Bon Jovi world tour. Each copy of the album has a unique serial number, which consumers must register at Bonjovi.com to access the ticket offer.
