An Erie County (N.Y.) grand jury has indicted rap artist DMX (real name: Earl Simmons) for failing to show up at Cheektowaga Town Court to begin serving jail time for a traffic conviction last year. He is expected to be arraigned within the next two weeks on the new charges.
The contempt of court charge was slapped on the rapper the day after he began serving 13 days at the Erie County Correctional Facility for driving without a license. Simmons was released in March after belatedly serving out his sentence.
His short stay in the slammer was, however, not without incident. As previously reported, Simmons also faces felony assault charges in Alden following a scuffle with corrections officers while in prison.
About a week after his release, DMX celebrated as the film “Exit Wounds,” in which he starred opposite Steven Seagal, was the top grossing film in the U.S. in its opening weekend. The film — which has grossed more than $51 million in the U.S. — sported a Blackground/Virgin soundtrack featuring his single, “No Sunshine.” As previously reported, DMX will reteam with “Exit Wounds” producer Joel Silver for an as yet untitled remake of the 1931 German crime thriller “M.”
