European independent labels' body Impala has delayed making a final decision on whether to initiate a court challenge to the Sony BMG merger.

Impala deputy general secretary Helen Smith tells Billboard.biz that the Brussels-based association has postponed declaring its position while consultation continues with its lawyers. A decision had been expected this week.

"We're working on it, things are developing but we need more time with the lawyers before we make an announcement," Smith says. "We're making good progress," she adds. Sources suggest an announcement is likely in the week beginning Oct. 25.

Impala has long been a vociferous opponent of industry consolidation. As previously reported, members of the trade body members discussed the topic in a Sept. 30 meeting at the Popkomm trade fair in Berlin. Sources reported that a "high consensus" of the members at the meeting had agreed the merger should be contested.

The Sony BMG merger was cleared by the EC's competition department July 19. The U.S. Federal Trade Commission approved the deal without concessions July 28.
