Before the Second Circuit Court of Appeals handed down its big decision last year in Viacom v. YouTube, there was an expectation that that the appellate judges would offer some needed clarity on when exactly internet service providers are safe from, or in danger of, copyright infringement liability. Now the case is back in court for further consideration -- the judge will have to figure out which side bears the burden of showing requisite knowledge of infringements at the summary judgment stage.
