Rap star DMX (real name: Earl Simmons) will be obliged to keep a return engagement in western New York, after a judge rejected an appeal by the rapper to overturn his 15-day jail sentence on a traffic charge. Simmons is expected to surrender within the ne xt two weeks to serve time in the Erie County Correctional Facility in Alden.

After a stop on the Ruff Ryders/Cash Money tour in Buffalo in March, police pulled over Simmons' car and charged him with speeding, failing to signal a lane change, driving wit h a suspended permit, and marijuana possession.

Simmons pleaded guilty to a reduced charge of driving without a license. He was ordered to serve a maximum 15-day jail term and fined $400.
