Although DMX (real name: Earl Simmons) is nominated for two Grammy Awards, he won't be in Los Angeles for the ceremony next Wednesday (Feb. 21). The rapper plans to surrender to authorities in Cheektowaga, N.Y., and begin a 15-day jail sentence as early as next week, according to his publicist.

"This is the first year he is nominated in two categories," a representative for the rapper said yesterday (Feb. 14), "but ... he understands he's a person that is admired by millions and he wants to set the proper example."

DMX is nominated for best rap album ("... And Then There Was X") and best rap solo performance ("Party Up") honors.

The artist was pulled over in suburban Buffalo last March, about three hours after performing a concert, and was sentenced last May for driving without a license. A warrant was issued last week for his arrest after he failed to meet a court-ordered deadline to begin his jail term.

His attorneys say the rapper has been in California fulfilling a previous commitment to work on promotional material for a movie. "He has every intention of honoring the court's mandate and plans to turn himself in immediately upon his return to the East Coast," attorney Matt Middleton said.
